Autelica Studio Terms of Service

These Terms of Service ("Terms") govern your use of Autelica Studio, including our web application, APIs, and associated services (the "Service"). The Service is operated by Autelica, Inc. ("Autelica," "we," "us," or "our"), a Delaware corporation based in San Francisco, California.
By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and Accounts
- Age Limit: You must be at least 18 years old to create an account or purchase credits or subscriptions.
- Google Sign-In: You register and sign in through your Google account. You must maintain the security of your account credentials.
- Responsibility: You are responsible for all activities under your account. Notify hello@autelica.com immediately if you suspect unauthorized access.
2. Your Content and Required Consents
Autelica Studio allows you to upload 2 to 4 synchronized videos of a person moving. We compute 3D body motion, sports metrics, 3D replays, and robotics data exports.
You represent and warrant that:
- Consents for Filming: You have obtained prior, explicit consent from every individual who appears in your uploaded videos.
- Minors: If a video depicts any minor under the age of majority, you have secured verifiable written consent from their parent or legal guardian before uploading.
- Lawful Capture: You recorded the video lawfully without violating any person's reasonable expectation of privacy.
- Rights: Your uploads do not infringe any third-party intellectual property, privacy, or publicity rights.
You assume full legal responsibility for all content you submit.
3. Licenses and AI Model Training Policy
- Service License: You grant Autelica a limited, worldwide, royalty-free license to host, store, transfer, and process your uploaded videos solely to deliver the Service to you.
- No AI Training by Default: We do NOT use your uploaded videos or motion data to train machine learning models. We will only train models on your content if you explicitly opt in through a separate account setting. That setting is off by default.
- Retention: We store raw video uploads in Google Cloud Storage in the United States. Uploads are deleted after 30 days by default.
4. Ownership of Outputs
- Your Outputs: You own all rights to the downloadable outputs generated from your uploads. This includes 3D joint coordinates, motion kinematics, sports analytics, 3D replays, and robotics export files.
- Our Intellectual Property: Autelica retains all rights to the Service, including our code, proprietary algorithms, model architectures, APIs, and brand assets.
5. Pricing, Credits, Subscriptions, and Refunds
- Billing: We provide processing on a pay-as-you-go credit basis and through recurring subscription plans. Payments are processed by Stripe.
- Automatic Refund for Failed Jobs: If a processing job fails due to an error on our system, the credits deducted for that job are automatically refunded to your balance.
- Subscription Cancellation: You may cancel a subscription at any time via your account settings. Cancellation takes effect at the end of your current billing cycle. We do not issue partial or prorated refunds for mid-cycle cancellations.
- Taxes: Stated prices exclude sales or value-added taxes, which are collected where required by law.
6. Acceptable Use
You agree to follow our [Acceptable Use Policy](acceptable-use.md). You may not:
- Use the Service for surveillance, spying, stalking, or unconsented identification of people.
- Upload videos of any individual without their consent (and guardian consent for minors).
- Use outputs for weapons, military targeting, or lethal autonomous systems.
- Reverse engineer, decompile, or extract the algorithms or models behind the Service.
- Bypass rate limits, access controls, or billing systems.
7. No Warranty: Measurements Are Estimates
- Estimates Only: All 3D joint positions, kinematics, velocity metrics, sports analytics, and visual 3D replays are mathematical approximations generated by computer vision algorithms. They may contain tracking errors or inaccuracies.
- Not for Medical Decisions: The Service is not a medical device. You must not use our outputs for medical diagnoses, clinical treatment, physical rehabilitation, or ergonomics assessments.
- Not for Safety-Critical or Legal Decisions: The Service must not be used in safety-critical systems, life-support applications, criminal investigations, or legal evidence.
- Robotics Data: Robotics data exports are simulation results. You must test and validate all motion data in isolated virtual simulations before executing them on physical hardware. Always maintain physical emergency stops and safety barriers.
- "AS IS": The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, statutory, or implied.
8. Limitation of Liability
To the maximum extent permitted by applicable law:
- Autelica, Inc. and its directors, employees, and agents are not liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or goodwill.
- Our total aggregate liability under these Terms or related to the Service is limited to the greater of fifty U.S. dollars ($50.00) or the amounts you paid to Autelica during the twelve (12) months preceding the claim.
9. Termination
- By You: You may close your account at any time.
- By Us: We may suspend or terminate your access immediately if you violate these Terms, breach our Acceptable Use Policy, engage in fraud, or create legal liability for others.
- Survival: Sections 3, 4, 7, 8, 10, and 11 survive termination.
10. Changes to Terms
We may update these Terms periodically. We will post updates with a revised "Last Updated" date and notify you of material changes by email or through the Service. Continued use after changes take effect constitutes acceptance.
11. Governing Law
These Terms are governed by Delaware law, excluding its conflict of laws rules. Any dispute arising from these Terms or the Service must be resolved exclusively in the state or federal courts located in Delaware, and you submit to personal jurisdiction in those courts.
12. Copyright Complaints
If you believe content uploaded to the Service infringes your copyright, send a notice to hello@autelica.com with the subject "Copyright notice". Include: your contact details; a description of the copyrighted work; the link or job identifier of the material; a statement that you have a good-faith belief the use is not authorized by the owner, its agent or the law; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. We will remove or disable access to the material and notify the uploader. Uploaders may send a counter-notice to the same address. We terminate the accounts of repeat infringers.
